WESTERN MONTANA FISH & GAME ASSOCIATION LIABILITY WAIVER

WAIVER OF LIABILITY, AGREEMENT TO HOLD HARMLESS, AND ASSUMPTION OF RISK

In consideration of the opportunity to use the Deer Creek Shooting Center (DCSC) or the Mineral County Shooting Sports Association (MCSSA) 1,000-yard range made available to WMFGA members for reasonable fees, and in recognition of the volunteer efforts of the Western Montana Fish and Game Association, Inc. (WMFGA) and MCSSA to maintain reasonably safe operations, conditions, and rules:

I, the undersigned, hereby agree to assume any and all personal risk involved in using the DCSC, using the MCSSA 1,000-yard range, or participating in any WMFGA or MCSSA events connected with such use. I agree to hold WMFGA, MCSSA, and their officers, directors, officials, and sponsors harmless for any injury or damage which I might incur. I further agree and understand that I waive all current and future rights to sue or collect damages from the above organizations and/or individuals as a result of any injury which I might incur. I acknowledge that shooting involves inherent risks including, but not limited to: firearm, archery, or shooting-related misadventures such as negligent discharges and ricochets. I further agree to indemnify and hold harmless WMFGA and MCSSA from any and all claims or lawsuits brought by any guest I bring to the DCSC, to the MCSSA 1,000-yard range, or to WMFGA or MCSSA events connected with such use, and I acknowledge that I will comply with all applicable DCSC and MCSSA safety and range use rules and procedures.

REQUIRED NOTICE UNDER 27-1-753, M.C.A.: By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider’s ordinary negligence that are the result of the provider’s failure to exercise reasonable care.
